In
August of 1998, Tulane University contracted FoxCor to review all outstanding
change order requests and to perform a review of the Contractor. FoxCor’s
services were necessitated by the General Contractors submission of
damages for delays claim for approximately $200,000 and an addition
of 6 months to the Contract Time. Initial review by FoxCor determined
that the monthly schedule submissions did not meet with the Contract
requirements and relationships contained within the schedule were inconsistent
from month to month making the schedule unreliable in determining delays
to the construction process. FoxCor also determined that some of the
costs included in the claim were non reimbursable by terms of the Contract.
The General Contractor reduced his claim to approximately $30,000.
FoxCor’s
review of the pending change order request revealed that the General
Contractor was a mere pass through for subcontractor and little review
had been performed on change order requests prior to their submission
to the Owner. In all FoxCor reviewed over $750,000 in change order requests
and negotiated a total savings to the Owner in excess of $200,000.
In
addition to the aforementioned problems, the Architects Contract contained
a sunset clause which made it possible for the Architect to bill as
additional services all work performed after the date set forth in the
sunset clause of his Contract. FoxCor was asked as an additional service
to review the Architects Contract and negotiate with the Architect to
final resolution. After completion for the negotiations FoxCor returned
a savings to the Owner of $150,000 in design fees from the initial request
of the Architect.
